By submitting the order form or making a payment, you confirm that you have read, understood, and agree to be legally bound by these Terms and Conditions, which constitute the entire agreement between detectordeia.es and you.

Basic Principles

1. Right of Confirmation

4. Right to be Forgotten

  • The users revoke their agreement to process their personal data, or there are no legal conditions to continue their processing;
  • The users object to the processing of their data if there are no legal conditions for it;
  • The period during which the data will be accumulated (if known);
  • The information collected has been processed illegally;
  • The personal data must be deleted in accordance with the respective regulations;
  • The user details related to the offers made by the information society services have been collected.

If someone firmly wishes to request the company to delete their data, they must send a request to the email provided at detectordeia.es. The company's staff will immediately inform users about the data deletion.

Let's assume that the private details of the clients have been made public and the data subject requests their deletion. In that case, the company must inform its partners of the clients' intentions and delete any personal contact if its processing is no longer necessary. Our employees will take all necessary steps to delete users' personal data in every situation.

5. Right to Limit Processing

Users can request that the company restrict the processing of their data if:

  • The accuracy of the information is against the user, which obliges the company to confirm the accuracy of the data provided;
  • The processing is illegal and the client requests not to delete, but to limit the use of their information;
  • The service provider no longer needs to process the personal details of the consumers;
  • The interests of the company compromise those of the users.
  • Contact us immediately if any of the aforementioned cases apply.

6. Right to Cancel Data Processing

You can refuse to process your data at any time. Contact us to inform us about your decision.

Company and Third-Party Legal Interests

In conducting our business, we strive to contribute to the well-being of our employees and partners.

Personal Information Storage Period

Personal information may be stored within the legal period after which it is deleted.

We confirm that there are cases in which clients must provide their personal data due to a specific law or a contract condition. It may be necessary to make a contract to prove that a client gives us their personal data, which must be processed only by our agency.

Before providing personal data, the client must contact the company, which in turn must clearly state the reasons for using the clients' personal contacts.

Changes in the Policy

Sometimes, some modifications may be introduced to this policy. Once you create an account on our website, you agree to adhere to these terms and receive notifications about the changes made.

Data Protection (Google and Facebook)

The website uses services such as HotJar, Google Adwords, Google+, and Google Analytics. It also has links to Instagram, Facebook, and other social networks. Each third party has its own policies regarding data protection and processing.

User Agreement

Detectordeia.es (the "Site") and its services are maintained by System Technology Online Spain SL., Calle Pintor Pérez Gil 2, b.46 03540, Alicante, Spain, and are offered to you, the user ("You"), subject to your recognition of the conditions and terms, and notices contained here without modification (the "User Agreement"). By reading the information below, you (1) acknowledge that you have read, understood, and have the capacity and authority to enter into this User Agreement and (2) agree to abide by all its terms and conditions.

You should review this User Agreement carefully. If you violate the User Agreement, your authorization to use the Site may terminate automatically.

Scope of services.

The Site offers plagiarism detection services (the "Services") that allow you to check your work for possible textual matches against resources available on the Internet, the proprietary database of "detectordeia.es", and licensed databases from other third parties. The Site is owned and operated by detectordeia.es, its subsidiaries, affiliates, licensors, and/or providers. These parties own all rights to all materials created by the Services, including the format of reports that evaluate textual sources ("Reports"), and all related intellectual property rights. Except for the limited license granted below, nothing in this Agreement grants you any rights, title, or interest in the Site or Services or any confidential information or intellectual property of "detectordeia.es". Any rights not granted to you by this User Agreement are reserved for detectordeia.es and/or its affiliates, providers, and licensors.

Submitted Works.

Please note that the works submitted to the Site are not read or reviewed by any individual, but are only analyzed using the review and detection services of detectordeia.es.

License to use the services and the site.

Detectordeia.es grants you a non-transferable and exclusive license to use the Services and the Site solely for your personal and non-commercial use to obtain the Reports for which you have paid the applicable fees. No other license is granted by implication. You may not modify, transmit, display, publish, license, perform, copy, distribute, reproduce, create derivative works from, transfer, or sell any information or the Services of the Site without the prior written consent of detectordeia.es. Additionally, you agree not to cause or allow the disassembly, decompilation, recompilation, or reverse engineering of the Site or the Services. You may not remove any ownership notices (e.g., copyright and trademark notices) from detectordeia.es from the Site, the Services, or the Reports. Only you may use your password to access and use the Services. You should not share your password with anyone else.

Suspension.

Detectordeia.es may suspend or terminate your access to the Site and Services, at its sole discretion, to (i) prevent damage or degradation of the Services; (ii) comply with any regulation, court order, law, or other government requests; (iii) protect itself from potential legal liability, or (iv) address a breach of this User Agreement.

Disclaimer.

The site, services, and reports are provided "as is", with all faults and "as available". detectordeia.es and its licensors do not guarantee that the site, services, or reports will meet your requirements or that any report, result, or comparison generated by the site will be complete or accurate. detectordeia.es does not guarantee that access to the site or the use of the licensed services or programs will be uninterrupted or error-free or that defects in the site will be corrected. To the maximum extent permitted by law, detectordeia.es and its licensors disclaim all representations and warranties, express, implied, or statutory, including, but not limited to, any warranties of merchantability, fitness for a particular purpose, title, non-infringement, and accuracy of information. The services are accessed and used through the Internet. You acknowledge and agree that detectordeia.es does not operate or control the Internet: (I) viruses, worms, Trojan horses, or other unwanted data or software; and/or (ii) unauthorized users (e.g., hackers) may attempt to gain access to, damage, or interfere with your data, computers, or networks. detectordeia.es will not be liable for such activities.

Limitation of Liability.

Neither detectordeia.es nor its licensors, suppliers, and their respective affiliates shall be liable for any theory for damages of any kind (including, but not limited to, direct, indirect, incidental, consequential, exemplary, or damages resulting from loss of profits, lost data, or business interruption) arising from the use of the site, reports, services, or information contained therein, for any reason, even if detectordeia.es, its licensors, suppliers, and their respective affiliates have been advised of the possibility of such damages. In any case, the collective liability of detectordeia.es, its licensors, suppliers, and their respective affiliates to you or any third party for all damages, losses, and causes of action (whether in contract, tort, including negligence, or otherwise) arising from this user agreement or in any way related to this agreement shall not exceed the amount of fees paid to detectordeia.es for the services during the thirty (30) day period immediately preceding the event that first gave rise to the liability. You assume all responsibility and obligation to interpret the report or share the report with any third party. Some jurisdictions do not allow the limitation or exclusion of liability for incidental or consequential damages; in those jurisdictions, detectordeia.es' liability under this user agreement shall be limited to the maximum extent permitted by law.

Indemnification.

You agree to indemnify, defend, and hold harmless detectordeia.es, its affiliates, agents, officers, directors, employees, suppliers, and licensors from any claims, losses, damages, liabilities, costs, and expenses (including attorney's fees and costs) arising from your (a) use of the Site or Services, (b) violation of any third party's rights, or (c) breach of this User Agreement. For clarity, this indemnification applies to both direct claims between you and detectordeia.es and any third-party claims. You agree to cooperate as reasonably necessary in the defense of any claim. detectordeia.es reserves the right, at its own expense, to assume exclusive defense and control of any matter otherwise subject to indemnification under this section, and in any event, you agree not to settle any such matter without the prior written consent of detectordeia.es. Your obligation to defend and indemnify detectordeia.es survives the termination of this User Agreement and your use of the Site.

External hyperlinks to or from the Site do not constitute an endorsement by detectordeia.es of, affiliation with, or recommendation of any third party or their website, products, resources, or other information. detectordeia.es is not responsible for any software, data, or other information available on any third-party website. You are solely responsible for complying with all terms and conditions of use for third-party websites. You acknowledge that detectordeia.es will have no liability for any damage or loss arising from your access to, use of, or reliance on any third-party website, software, data, or other information.

General.

The performance of detectordeia.es under this User Agreement is subject to existing laws and legal processes, and nothing contained in this User Agreement diminishes detectordeia.es' right to comply with requests or legal requirements related to your use of the Site or Services or information provided to or collected by detectordeia.es regarding such use. If any part of this User Agreement is deemed invalid or unenforceable under applicable law, including, but not limited to, the disclaimers of warranty and limitations of liability set forth above, such provisions shall be deemed superseded by a valid and enforceable provision that most closely matches the intent of the original provision; the rest of the User Agreement shall remain in effect. A printed version of this User Agreement and any notice given in electronic form shall be admissible in judicial or administrative proceedings based on or relating to the User Agreement to the same extent and subject to the same conditions as other documents and business records originally generated and maintained in printed format. This User Agreement constitutes the entire agreement between You and detectordeia.es regarding its subject matter and supersedes any and all prior negotiations, representations, and agreements, whether written or oral, between the parties.

Refund Policy

All payments for plagiarism checking, AI detection and subscription plans are non-refundable, except as expressly stated below.

A refund for the most recent billing period may be considered only if all of the following conditions are met:

  • the refund request is submitted within 5 (five) calendar days of the charge; and
  • no usage of the service has occurred during that billing period.

Refunds are not provided for any earlier billing periods under any circumstances.

The review and approval of any refund request remain at the sole discretion of DetectordeIA.es.

Usage Definition

For the purposes of refund eligibility, “usage” includes any submission, API request, or interaction with paid features of the service during the relevant billing period.

Refunds and Reviews Related to "Other Services"

1. Customers who use our editing/revision services can request a refund within 14 days after the order deadline expires. Our refunds department will investigate the matter. Customers will receive a response in 3-4 business days.

2. Editing and revision services involve only grammatical and formatting corrections. The company is not responsible for plagiarism found in the client's text.

3. Services related to plagiarism checks through our search engines detectordeia.es, AI checks, and readability services are non-refundable.

Refund Request

To request a refund, a customer must send their request by email, indicating the reason for the refund, to [email protected]. Our Refund Team will inform you about the result of the request in 3-4 business days.

End User License Agreement

1. Our Company's Responsibilities

a. Customers of detectordeia.es are granted the rights they may need to access and use the services provided by our company according to the terms and conditions of this User Agreement. This right of use is revocable, limited, non-exclusive, non-transferable, and non-assignable, and is available to customers worldwide. The customer agrees that our company will retain all interests, rights, and titles to our services. This includes – without any limitation – interest in, rights, and title to any logos, user interfaces, trademarks, and graphics where these are reproduced during the use of our services. Customers are not granted any rights to the services provided by detectordeia.es or to any part of these through this User Agreement nor does it grant any rights or license to our company's intellectual property. The customer acknowledges that detectordeia.es and the component parts of its services are fully protected by applicable copyright law and other relevant laws.

b. detectordeia.es will provide you with any information you need to securely access the current version of our company's services.

c. Our company will apply its Privacy Policy to keep the client's content and information confidential.

d. detectordeia.es will store all client content in a private and separate manner so that any document sent can only be accessed by their own user group/community and reviewed for plagiarism.

e. detectordeia.es will provide you with appropriate access and control to help you maintain copyright over your content. This will include the right to access and download any submitted material as needed and to remove your content if, for any reason, the services we provide to you and/or our agreement with you is canceled or terminated.

f. Our company is committed to providing any technical or administrative support you, your users, or your agents may need by phone, live chat, or via email at the address provided on our website.

g. Our company reserves the right to suspend or terminate access to our services that has been granted to a client where:

  • they violate any of the terms of this Agreement and/or our Privacy Policy;
  • they allow unauthorized access to our services;
  • they use our services in a manner that is not consistent with the type of subscription they have contracted.

h. Our company reserves the right to change, remove and/or add – periodically – various aspects of the functionality, features and prices of our services.

2. Client Responsibilities

a. It is the client's responsibility to provide detectordeia.es with accurate and correct information.

b. The university's IT department must be allowed to incorporate the systems and services provided by detectordeia.es into the systems used by its university campuses, but only through a code approved by detectordeia.es.

c. Our company offers a learning and teaching service designed to identify and provide a method for examining possibly plagiarized pieces of writing. The tool provided by detectordeia.es should not be used solely as the only authoritative method by a person attempting to propose cases of alleged plagiarism, i.e., if they intend to pursue a legal sanction or procedure.

d. The client grants detectordeia.es the license and right (without fee) to use and incorporate any testimonial, improvement, suggestion, or other piece of feedback that they provide regarding our company's services.

e. The client agrees not to access or use the services provided by detectordeia.es to create a product or service that competes with ours.

3. Subscription Levels and Fees

a. Customers can access the services offered by detectordeia.es for a limited and unique period at no cost to evaluate the service. We can only offer a free period for any single entity. The customer can cancel their subscription at any time within the first 14 (fourteen) days of their subscription if no shipments have been used. If the customer has already used part of the paid shipments, only a partial refund will be considered after investigation by the Financial Department. A customer can send a request to the support team via email or the Live Chat option.

b. An updated list of our rates is always available on the detectordeia.es website, and is subject to change at the discretion of our company's administrators. The prices listed on our site do not include applicable taxes and duties, the coverage of which is the responsibility of the customer. Our payment terms apply to payments received through the 2CheckOut payment system.

c. Subscription rates can be paid online using 2CheckOut. Trusted payment processing companies handle both payment methods securely.

d. Subscription Renewal and Cancellation. Subscriptions are billed on a recurring basis (monthly, quarterly, or yearly, depending on the selected plan) and will automatically renew unless cancelled by the user before the next billing date. Users may cancel their subscription through their account dashboard or by contacting support before renewal. Cancellation stops future renewals only and does not retroactively cancel the current billing period.

e. User Responsibility for Cancellation. Users are solely responsible for managing and cancelling their subscriptions before the renewal date. Failure to cancel a subscription before renewal does not, by itself, entitle the user to a refund.

4. SLA – Service Level Agreement

Technical Support Level

The time it takes to resolve an issue generally depends on how complex the reported problem is. In case of a problem, customers should contact our support staff by phone, live chat, or email at the address provided on our website.

5. Advertising and Confidentiality

detectordeia.es may occasionally use any confidential or personal information provided by the client, but only in relation to the use of the service we provide and as permitted under the terms of this User Agreement. Each party to the Agreement is expected to take all reasonable measures to prevent unauthorized use, dissemination, or disclosure of such confidential or personal information. These measures will include, at a minimum, those that the company and the client would take in normal circumstances to protect our own information where it is confidential, personal, or similar. The client agrees that the name of their entity and any associated logo may be used on our company's website and in any promotional or advertising material produced by the company. detectordeia.es may advertise that you are a client of our company's services.*

* – applicable only to corporate clients. Individual user names will not be displayed on the website.

6. Force Majeure

a. detectordeia.es will not be responsible for any failure or delay in the performance of various obligations related to this User Agreement when these result from any activity or omission outside the reasonable power or control of the company. Such failures and/or delays may include riots, embargoes, terrorist activities, war, blockades, labor disputes or other similar industrial interruptions, force majeure events, systemic failures related to telecommunications, power outages and other utility failures, storms, earthquakes or other natural disasters, orders or acts of a governmental nature.

b. No Third-Party Beneficiaries. No rights of third-party beneficiaries are created or granted under the terms of this User Agreement, i.e., in cases where an entity or individual is not a legitimate party to this User Agreement.

c. Legal Notices. In case it is necessary or permitted for any of the parties to this User Agreement to issue legal notices, these must be presented in writing to the applicable addresses (or according to the procedure described in the relevant section of this Agreement, as these details may change partially or completely over time). Additionally, our company may issue notices related to operational or technical aspects of the service. Notices of this type will be published on the detectordeia.es website, or sent by email, and will be considered received at the time of publication or at the time of their sending. Language Use. Our company establishes that English is the language to be used in all notices or communications issued or made in relation to this Agreement.

d. Changes or Alterations to this User Agreement. detectordeia.es reserves the right to alter this User Agreement, its related Privacy Policy, and our Acceptable Use Policy at our sole discretion. We will notify customers by publishing changes on our website, where we also publish any revised version(s). Continued use of the service provided by detectordeia.es after such notifications become effective indicates agreement with any changes and acceptance of them as binding.

e. Separation of Parts of this Agreement. If any part of this User Agreement is found to be unenforceable or invalid, the remaining parts shall remain in full force and effect. Any part deemed unenforceable or invalid shall be considered as maintaining the intent and purpose of the original part. If this interpretation proves impossible, we will separate the offending parts of this User Agreement while the remaining parts remain in full force and effect.

7. Property Rights

a. The client, their users, or their agents will retain and own all rights, interests, and titles to their content. Except for the exclusions described in this part of the agreement (Property Rights), our company has no right to the content that belongs to them, their users, or their agents.

This includes any rights related to copyright and intellectual property. The client consents to our company using and disclosing their content only to allow us to provide our services to them, their users, or their agents, or for the purpose of complying with any court order or order from a government body or administrative agency.

b. The client warrants and represents to our company that:

  • they, their users, or their agent(s) are the owners of all interests, rights, and title in the client's content or that they have a suitable license to access and use such content as considered by this User Agreement;
  • they have all the necessary rights over their content to grant us the rights we require under the terms of this User Agreement;
  • none of the client's content, nor the use of such content by their users or their agents, will infringe our service's acceptable use policy. To avoid any doubt, all parties to this user agreement acknowledge and agree that the foregoing conditions do not apply to any content that infringes or plagiarizes the copyright of any other (third) party, the detection of which is the reason for which the service provided by detectordeia.es was designed.

c. Our company reserves and owns all interests, rights, and title in the services provided by detectordeia.es. Our company grants clients a revocable, limited, non-transferable, non-assignable, and exclusive right to the following during the duration or term of the Agreement: access and use the service provided by detectordeia.es solely in accordance with the terms of this User Agreement;

use and copy the documentation provided by detectordeia.es only to the extent that the client is permitted to use our service, which extends to any rights associated with our intellectual property.

d. The client, its users, or its agent(s) must not use the service provided by detectordeia.es for any purpose or in any manner except as explicitly stated in this User Agreement. Furthermore, the client, its users, or its agent(s) must not attempt to:

  • alter, modify, repair, interfere with, or create copies or derivatives of any program or software provided as part of the services offered by detectordeia.es;
  • decompile, disassemble, reverse engineer any part of the service or attempt to apply any procedure or process designed to discover the source code related to any program or software provided as part of the Service;
  • attempt to access or use the service provided by detectordeia.es in any manner designed to avoid incurring charges or exceed the usage quotas or limits.

e. Any license or right granted to the client under the terms of this User Agreement is provided on a conditional basis and depends on the client continuing to comply with the terms of this User Agreement. Failure to comply with all or any of the conditions of the aforementioned Agreement will result in the automatic and immediate termination of the service. If the Agreement is terminated due to non-compliance, no charges will be refunded. During the term of the agreed Term and after it expires, the client will not authorize, assert, encourage, or induce any other party to assert against detectordeia.es, our clients, partners, licensors, suppliers, or affiliates any claim of infringement related to intellectual property and/or patent belonging to the service we offer.

8. Termination of Agreement and Agreement Termination

a. Termination of Agreement

The usual term of the User Agreement between the client and detectordeia.es begins on the payment date, i.e., the Effective Date. Annual subscriptions are automatically renewed before they expire unless the Agreement is terminated under the conditions listed below:

b. Termination for Convenience

Customers have the option to terminate their detectordeia.es subscription. There are two ways to do this, which are:

  • through a notification by email to the address provided on our website (or using the Live Chat option);
  • by not making the annual payment when it expires before the renewal date.

The client's access to the services of detectordeia.es will automatically terminate at some point during the three to four days following the non-payment. Anyone who wishes to restore access to our service may need to pay a fee for reactivation.

Applicable Law and Dispute Resolution

This agreement and any claim, controversy or dispute related to or arising from it shall be governed, interpreted and construed in accordance with Spanish law.
